| 1) The contracting authority has the right to conduct negotiations with tenderers on the submitted tenders with the aim of finding a more suitable procurement result for the contracting authority. The technical description of the public procurement and the draft contract are set as initial conditions and are therefore, where necessary, subject to negotiation and may change during the negotiations. 2) The contracting authority also has the right to conduct negotiations with the aim of bringing the submitted tender into conformity with the conditions set in the procurement documents. The evaluation criteria shall not be subject to negotiation. 3) Conducting negotiations is not obligatory for the contracting authority, including that the contracting authority is not obliged to enter into negotiations if at least one tender complies with the initial conditions set out in the procurement documents. 4) During the negotiations, the contracting authority shall, where necessary, give tenderers the opportunity to submit an adapted tender. | |||
